Last year’s tariffs in the US impacted practically every gaming manufacturer, including Nintendo. The Japanese gaming giant was quick to raise Nintendo Switch 2 accessory prices before the console was even released, but it has yet to raise prices of the console itself.
In an interesting turn of events, Nintendo recently filed a lawsuit against the US for imposing unfair tariffs on imported goods. Perhaps even more interesting is the fact that Nintendo is now being sued following this lawsuit.
Why it matters: Nintendo is typically one doing the suing, so it comes as a surprise that the company has seemingly been sued as a consequence of one of its lawsuits.

For context, Nintendo sued the US government and demanded refunds after the Supreme Court struck down last year’s tariffs.
This led to two gamers, Gregory Hoffert and Prashant Sharan, filing a lawsuit demanding Nintendo pass these refunds on to any customers who purchased products between February 1, 2025 and February 24, 2025.
Both customers claim to have purchased products from Nintendo at new prices, and they argue that Nintendo is attempting to profit from refunds after already benefitting from increased prices during the tariffs.
As reported by Gamefile, the US government is willing to offer up to $160 billion for companies impacted by the tariffs. In the event that Nintendo does end up securing refunds for itself, it will be interesting to see whether this lawsuit from the two gamers will move forward.
Also, other companies like FedEx have been similarly sued over tariff refunds despite promising to pass on these refunds to customers.
Anyhow, even with the tariffs not leaving too big an impact on the company’s products, the ongoing memory shortages pose a huge threat to the Nintendo Switch 2, which could see a price hike later this year.
